Section 3901.07(A)(2) gives the Superintendent the authority to examine any foreign or alien insurance company at any time. This Bulletin outlines the Department's procedure for conducting examinations of foreign or alien insurers.
The Department will examine all foreign and alien insurance companies not less frequently than once every five years. In lieu of the Department's examination, the Department will accept the report of examination from the state of domicile or from the port of entry state.
However, beginning January 1, 1994, whenever such examination of a foreign or alien insurance company is required, this Department will only accept a report of examination from the state of domicile or port of entry state, if such state has been accredited under the National Association of Insurance Commissioner's Financial Standards and Accreditation Program, or that the examination was performed under the supervision of an accredited insurance department, or with the participation of one or more examiners who are employed by such an accredited insurance department and who, after a review of the examination workpapers and report, state under oath that the examination was performed in a manner consistent with the standards and procedures required by their insurance department.
